By enrolling in the Cheers to You! Rewards & Recognition program (“Program”), the
Dunkin’ Brands, Inc. (“Dunkin’”) Franchisee (“Franchisee”) authorizes and consents to the following Terms and Conditions between Business Impact Group (“BIG”) and the undersigned Franchisee.
1. Program Information & Resources
Franchisees are encouraged to review additional Program details, including
available point types and participation options, by referencing the “More About the
Program” materials and attending Cheers to You! informational sessions.
These resources provide important guidance on Program structure, available
components such as Early Retention Milestone Automation, Online Leadership
Awards, Physical Point Cards, and Digital Point Codes, and best practices for
participation.
2. Tax Responsibility
BIG does not provide tax advice and is not responsible for determining how
rewards issued through the Program are taxed for employees. If an employee is
terminated and forfeits unused points, this does not constitute a taxable event.
It is the sole responsibility of the Franchisee to:
• Track employee redemptions where applicable.
• Communicate applicable earnings to their payroll provider or internal
payroll team for tax reporting purposes.
3. Terminated Employees
Employees who are terminated are not eligible to redeem points through the
Program. Franchisees are responsible for ensuring terminated employees are
promptly updated within The Center to prevent unintended access (see section 8
for more details on data accuracy). BIG is not responsible for redemptions or
Program activity resulting from delayed or inaccurate employee status updates
within The Center.
4. Billing Terms
Franchisees will be billed upon redemption of points within the Program
Rewards Gallery. Payments will be automatically processed through HubKonnect using the ACH account on file for any redemptions made within the past 24 hours
5. Point Expiration & Program Rules
Points do not expire and are non-transferable between employees. Once points
are issued to employees, they are not able to be returned or reallocated. Neither
BIG nor Dunkin’ are responsible for the misallocation of points by Franchisee.
Points may be accumulated and used as a singular currency within the Rewards
Gallery. Team members may combine points earned from work performance
and/or milestones achieved to redeem for higher-value items within the Rewards
Gallery; including, but not limited to:
• Early Retention Milestone Automation & Online Leadership Awards
• Physical Point Cards
• Digital Point Codes
6. Program Participation & Cancellation
Franchisees may choose to participate in the Automated Program Subscription
component (Early Retention Milestone Automation & Online Leadership Awards).
Physical Point Cards and Digital Point Codes do not require a cancellation notice.
However, if a Franchisee chooses to discontinue use or distribution of Physical
Point Cards or Digital Point Codes that have already been ordered, it is strongly
recommended that they contact BIG to request cancellation or deactivation of any
unused codes that may still be in circulation.
Franchisees are solely responsible for communicating any Program participation,
changes, or cancellations to their employees. BIG will not communicate individual
franchise-level Program changes directly to employees.
Program cancellation does not impact points previously issued to employees or
prior redemption obligations.
7. Employee Data Authorization and Consent Agreement
A. Authorization to Access and Maintain Employee Information:
The Franchisee hereby authorizes Dunkin’ to transfer and BIG to receive, access,
store, and maintain their employee personal information for the purpose of
administering an employee rewards and recognition Program, related services,
communications, and incentives.
The employee personal information that the Franchisee authorizes BIG to collect
and use includes:
• Employee name
• Employee email address
• Restaurant assignment (PC number)
• Job level
• Hire date
The Franchisee represents and warrants that it has all necessary rights,
permissions, notices, and consents required under applicable law for Franchisee
and for Dunkin’ to provide such employee personal information to BIG for the
purposes described herein, including for the purposes of Recognition Program
configuration, administration, and reporting.
B. Franchisee Ownership and Responsibility
The Franchisee acknowledges and agrees that all employees whose information is
provided to BIG are employees solely of the Franchisee and not of BIG or Inspire
Brands.
C. No Employment Relationship
Nothing in these Terms and Conditions shall be construed to create any
employment relationship between BIG and any employee of the Franchisee.
BIG's receipt, storage, maintenance, or use of employee personal information does
not create, and shall not be interpreted as creating, any employer, co-employer,
joint employer, agency, partnership, or similar relationship between BIG and the
Franchisee's employees.
D. Data Security and Use
BIG will maintain commercially reasonable administrative, technical, and physical
safeguards designed to protect the employee personal information received from
Dunkin’ against unauthorized access, disclosure, alteration, or destruction.
BIG will use employee personal information only for legitimate business purposes
related to the administration of the Program and its related services provided to
the Franchisee.
8. Data Accuracy & System Responsibility
Franchisees and their designated leaders are responsible for maintaining accurate
employee data within The Center.
Accurate data is critical for:
• Ensuring new employees or returning employees are properly setup within
The Center.
• Ensuring terminated employees are properly removed and no longer have
access to the Program or points.
• Assigning Online Leadership Awards only to employees designated with a
“manager” or higher role.
• Triggering Early Retention Milestone Automation awards based on
accurate team member start dates at 10, 30, and 60 days.
Franchisees and their designated leaders (those identified on the member file with
the role of ARL and Full Access), as identified through The Center, will be granted
“admin” access within the platform. This access allows visibility into reporting
related to employee point issuances and point redemptions.
BIG is not responsible for any issues, including but not limited to incorrect eligibility, improper point distribution, or unintended access, resulting from inaccurate or outdated data within The Center.
Updates made to employee data in The Center will be reflected within the Program
following the next daily member file feed.
9. Liability Limitation
BIG acts solely as a technology and fulfillment provider for the Program.
BIG is not responsible for:
• How Franchisees choose to administer or communicate the Program
internally.
• Any tax treatment, reporting, or compliance obligations.
• Employee disputes related to rewards, points, or recognition.
• Errors resulting from incorrect or incomplete data provided by the
Franchisee.
• Tracking outstanding point liability for the franchise.
Participation in the Program is at the discretion and responsibility of the
Franchisee.
10. Program Modifications
BIG reserves the right to update platform features and rewards at any time to
continuously improve the user experience, provided such changes do not affect
the core functionality of the Program or materially degrade the Program.
11. Acceptance
By accepting these Terms and Conditions, the Franchisee acknowledges that they
have read, understood, and agree. By accepting these Terms and Conditions, the
Franchisee authorizes BIG to access, receive, store, and maintain their employee
information to administer the Program in accordance with these Terms and
Conditions.
